In accordance with rules provided in "Interpretation of the Supreme People's Court on several specific questions of applying law for hearing criminal case of illegal publication", for the purpose of seeking private interests, attempting one of piracy acts described in term No. 217 of the criminal law, more than 50000 yuan of personal illegal gains and/or more than 200000 yuan unit illegal gains full into "relatively large amount of illegal gains. Having one of circumstances listed below full into "having other serious circumstances":
1. Acts which have ever been investigated into administrative or civil responsibility because of piracy more than two times, and implement one of piracy acts listed in term No. 217 of the Criminal Law within two years.
2. Personal illegal gains is more than 200000 yuan. Unit illegal gains is more then 1 million yuan.
3. Act which cause other serious consequences.
For the purpose of seeking private interests, attempt one of piracy acts described in clause No. 217 of the Criminal Law, more than 200000 yuan of personal illegal gains and/or more than 1 million yuan unit illegal gains full into "big amount of illegal gains". Having one of circumstances listed below full into "having other particularly serious circumstances":
1. Personal illegal gains is more than 1 million yuan. Unit illegal gains is more than 5 million yuan.
2. Acts which cause other particularly serious consequences.
For "big amount of illegal gains" crime of infringing duplicate convicted judicial interpretation of the Supreme People's Court provides that for the purpose of seeking private interests, attempting one of piracy acts described in term No. 218 of the Criminal Law which made more than 100000 yuan of personal illegal gains and/or more than 500000 yuan unit illegal gains will be convicted of and punished for the crime of selling infringing duplicate.
