1. Documents required for filing trademark application
1.1 A form of request for trademark registration (including the applicant's name both in Chinese and English,
1.2 Address,
1.3 Goods/services class according to the International Classification of Goods and Services for the Purposes of the Registration of Marks, and
1.4 A list of designated goods/services intended etc.)
1.5 A Power of Attorney duly signed by the applicant for trademark application (which could be downloaded from hereafter).
1.6 8 copies of trademark samples plus 1 copy in black and white.
In case priority is claimed, certified documents must be produced. If designated goods are medication for human use, certificates for manufacturing/operation from the health administrative authority must be produced.
2. Time estimate for trademark registration and the duration of trademark right
The processing time for trademark registration application needs approximately 15 to 18 months from the date of filing to the date when the right granted.
Once the trademark is successfully registered, its validity extends to 10 years. Before its expiry, it can be renewed for another 10 years. There are no times limit for renewal.
3. Cost estimate and duration for filing trademark application abroad
The fees chargeable for application for trademark registration outside of China may be in a lump sum manner. For those applications for trademark registration to be filed in USA, Japan, Hong Kong, European countries as well as Middle East countries, the fees are higher than those for Korea, Brazil and other countries of the South America.
